AVENU ACFR STATISTICAL SECTION REPORT SERVICES TERMS AND CONDITIONS By purchasing ACFR Statistical Section Report Services from Avenu I agree to the following terms: 1. Agreement to Pay. I agree to pay the price for the ACFR Statistical Section Report, as quoted in the invoice to me, within 30 days after receiving the ACFR Statistical Section Report from Avenu. 2. No Warranties. Avenu provides the ACFR Statistical Section Report, and the information contained in it, as-is. To the extent allowed by law, Avenu disclaims any warranties on the ACFR Statistical Section Report and the information in it including, but not limited to, warranties of merchantability or fitness for a particular purpose, and warranties to any third-parties who may ultimately receive some or all of the ACFR Statistical Section Report. 3. Limitation on liability. Except to the extent required by law, Avenu (including its employees, officers, directors, and agents) will not be liable to me or anyone else on any legal theory for any indirect, incidental, special, punitive, exemplary, or consequential damages related to the ACFR Statistical Section Report, even if Avenu had been advised of the possibility of such damages. 4. Indemnity. I will hold Avenu harmless for any claims, damages, liability, etc. arising from or related to my use of this report, including but not limited to my use of this report in dealings with or reporting to government agencies or third-parties.
