1. AGREEMENT: Please read these official rules (the “Official Rules”) carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter the Norwegian Cruise Line Travel Partner Appreciation Giveaway (the “Promotion”) sponsored by NCL (Bahamas) Ltd., d/b/a Norwegian Cruise Line (the “Sponsor”).
2. ELIGIBILITY: This promotion is open to travel partners who are legal residents of the 50 United States of America, the District of Columbia (“DC”) and Canada (excluding Quebec), who are twenty-one (21) years of age or older (“Participant” or “entrant” or “you”).
Employees, officers, directors, agents, or representatives, of the Sponsor, its respective parent companies and respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment, and execution of this Promotion (collectively, the “Promotion Parties”), and the immediate family (spouse, parents, siblings and children) of, and/or those living in the same household of each, are not eligible to enter the Promotion.
The Promotion is subject to all applicable federal, state, territorial, municipal and local laws and regulations. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry may be deemed ineligible. Sponsor reserves the right to verify eligibility requirements. Void outside the fifty (50) United States of America, DC, Canada and wherever else prohibited by law. Winning a prize is contingent upon fulfilling all the requirements set forth herein.
3. PROMOTION PERIOD: The Promotion begins at 12:00:01 PM Eastern Time (“ET”) on April 30, 2024, and ends at 12:00:00 PM ET on May 20, 2024 (the “Promotion Period”). Sponsor’s database clock will be the official timekeeper for this Promotion.
4. HOW TO ENTER: To enter the Promotion, (i) entrants are required to publish a post related to Norwegian Aqua on social media between April 30, 2024, and May 20, 2024; (ii) entrants must include #Sweepstakes on all entry social media posts; (iii) entrants must complete the submission form at https://www.survey.com/r/G5928PD during the Promotion Period and follow the instructions to complete and submit the online entry form, including, but not limited to, providing proof of the post related to Norwegian Aqua, your first name, last name, a valid email address, phone number, agency address, agency booking number, and link to your social media profile used to make the post related to Norwegian Aqua; and (iv) entrants must click “SUBMIT” to confirm that he/she has completed and submitted the only entry form.
The Winners will be selected by random drawing by Sponsor from the submission forms completed by May 20, 2024, at 12:00:00 PM ET.
5. PRIZES: Ten Grand Prizes (10) are available, each is a cruise for one (1) winner plus the winner's one guest from the Applicable Voyages set forth below in a double occupancy stateroom (approximate retail value up to $4,000 USD).
Odds of winning the Grand Prize will depend on the total number of eligible entries received during the Promotion Period. Entrants may make multiple entries during the Promotion Period, provided however, that an entrant may only be eligible to win one Grand Prize no matter the amount of entries made by the entrant.
Grand Prize Conditions:
The Grand Prize Winners will be able to choose one sailing from the voyages listed on www.ncl.com/vacations that do not meet the blackout qualifications listed below ("Applicable Voyages"). The Grand Prize sailing includes one double occupancy stateroom per Grand Prize Winner and one (1) guest.
All expenses related to the acceptance or use of the Grand Prize are the sole responsibility of the Grand Prize winner. Grand Prize winner is responsible for any and all local, state and/or federal taxes, and any other costs and expenses not specified herein.
No substitution of a Grand Prize will be allowed, except Sponsor reserves the right, in its sole discretion, to substitute prize(s) of comparable value if listed prize is unavailable, in whole or in part, for any reason. Prizes are non-transferable and are void if sold or exchanged for compensation.
All details and other restrictions of the Grand Prize not specified in these Official Rules will be determined by Sponsor in its sole discretion. Actual value of Grand Prize under this Promotion may be lower or higher at the time of its fulfillment, and any difference between actual value and the stated ARV (if actual value is lower than stated ARV) will not be awarded. Grand Prize ARV represents Sponsor’s good faith determination, is final and binding and cannot be challenged or appealed. Sponsor is not responsible if any element of the prize is delayed, postponed or cancelled for any reason. The Grand Prize is non-transferable, non-refundable, and no substitution or cash redemption will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right, for whatever reason, to substitute a prize (or any component thereof) for one of equal or greater value.
Grand Prize winner and his/her guest must be available to travel on one of the Applicable Voyages. Grand Prize winner must be able to accept the Grand Prize as presented or the Grand Prize will be forfeited in its entirety and an alternate potential winner may be selected in Sponsor's sole discretion.
Unless otherwise indicated, this Promotion may not be combined with any other offers or promotions. Reservations and sailing are subject to terms and conditions, availability and blackout dates, which are the decisions of Sponsor. Prize excludes airfare, ground transfers, government taxes, fuel supplements, service charges, shore excursions, post sailing hotel stay and other personal expenditures. The onboard service charges must be pre-paid under this program. Grand Prize is for a double-occupancy stateroom; stateroom upgrades will not be provided by Sponsor. Sponsor is not responsible for any local hotel stays due to airline layovers or missed flights. Grand Prize Winner must be an adult twenty-one (21) years or older. All other expenses not specified herein with respect to prizes are the sole responsibility of the Grand Prize winner. Changes or cancellations made less than one-hundred-twenty (120) days from original sailing date will result in a forfeiture of the cruise.
Sponsor’s determinations regarding the awarding of the Grand Prize is final. No prize substitutions except as provided herein. Ships’ Registry: Bahamas. No individual (including any Guest) under twenty-one (21) years of age will be booked unless accompanied by an adult twenty-one (21) years or older. Prizes are not transferable and may not be given, bartered, sold, or exchanged for cash or another prize, except at Sponsor’s sole discretion due to prize unavailability for any reason and then only for a prize of equal or greater value.
Once a Grand Prize Winner reserves a Grand Prize Cruise from the Applicable Voyages, it is not cancelable, and if the reserved cruise cannot be taken, it will be forfeited.
Taxes on Grand Prizes are the sole responsibility of the Grand Prize Winners. Sponsor, in its sole discretion, reserves the right to substitute prizes of equal or greater value if advertised prizes become unavailable. Sponsor's determinations regarding the awarding of prizes are final. No prize substitutions except as provided. Prizes are non-transferable. No cash alternatives.

6. PRIZE WINNERS: Sponsor will select the potential Grand Prize winners in a random drawing conducted at Sponsor’s offices. Sponsor’s decisions are final.
Ten (10) potential Grand Prize winners will be randomly selected from among all eligible entries received during the Promotion Period on or about May 20, 2024. Sponsor will contact the potential Grand Prize winners by e-mail or phone call submitted by potential winner at the time of entry, and eligibility is subject to verification. Sponsor will make a minimum of two (2) attempts to contact the potential winners within forty-eight (48) hours of the notification date.
If any potential winner cannot be contacted within ninety-six (96) hours of initial notification, after two attempts, including if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit any and all rights to the applicable prize) and the Sponsor reserves the right, in its sole and absolute discretion to randomly select an alternate eligible entrant for the prize in a separate random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.
The potential winner will become a confirmed and verified winner (a “Winner”) after meeting the requirements that follow: 1) Sponsor shall receive verification that Winner qualifies as being twenty-one (21) years of age or older; (2) a verified travel partner of Sponsor; and (3) successful completion of submission form and Norwegian Viva-related post in line with the terms set forth herein. This Promotion is governed by the laws of the United States and Canada, and all federal, state, provincial, and local laws and regulations apply. If potential winner is a Canadian resident, he/she must correctly answer a mathematical skill testing question as a condition of being awarded the Grand Prize.
The potential Grand Prize winners will be required to sign and return, within seven (7) days of notification, an Affidavit of Eligibility, a Liability Waiver, and a Publicity Release (where allowable), and an IRS W-9 form (collectively, "the Releases") as a condition of acceptance of a prize. Please note that the potential Grand Prize winner will be required to furnish his/her social security number on a W-9 form. Sponsor will only use information from the W-9 form to fulfill its tax obligations in connection with these Promotion and for no other purpose. The winner remains solely responsible for paying all federal and other taxes in accordance with the laws that apply in your state of residence. In order to redeem the Grand Prize, the winners must not only complete the Releases via DocuSign, but also a form to select the Applicable Voyage via DocuSign as well. Sponsor shall route the necessary forms and Releases via DocuSign to the winners.
All Releases must be received by Sponsor by the date provided in the respective notifications. If any potential winner cannot: (a) be contacted after two attempts, (b) fails to respond and/or to provide any of the requested Releases within the required time period, (c) is otherwise in non-compliance with these Official Rules, (d) declines to or cannot accept the prize to be awarded, or (e) fails to satisfactorily meet the requirements as determined in Sponsor's sole discretion, he/she will be disqualified and will no longer be eligible for a chance to win a prize.
Acceptance of the Grand Prize constitutes permission to use winner's name and/or likeness by Sponsor for purposes of advertising, editorial and trade purposes without further compensation, unless prohibited by law. By accepting a Grand Prize, each Grand Prize winner represents that he/she have complied with all rules of this Promotion and agree to release Sponsor and its parents, affiliates, subsidiaries, officers, directors and employees, crew members, media partners, printers of promotional material, promotional material suppliers, and advertising, promotion and other coordinating agencies involved in the promotion from any and all liability for injuries, losses, or damages of any kind sustained in connection with the use, acceptance, possession or awarding of prize or participation in any prize or related activities. Each Grand Prize winner further acknowledges that Sponsor has not made, and is not liable or responsible for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including, but not limited to, its quality, mechanical condition, or fitness for a particular purpose. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor which are final and binding in all respects. No more than the advertised number of prizes will be awarded. Entries become the property of Sponsor and will not be acknowledged.
No one is a Winner unless and until the Sponsor officially confirms him/her as a Winner in accordance with these Official Rules.
7. RELEASE; INDEMNIFICATION; DISCLAIMER OF WARRANTY: By participating in the Promotion, each entrant, his/her heirs, executors, administrators and assigns, releases, waives, discharges, and holds harmless the Sponsor, its parent company, and subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Promotion (collectively, the “Released Parties”) from any and all liability for any loss, harm, damage, injury, cost or expense of any nature whatsoever (including attorneys' fees) (collectively, "Losses") which may occur in connection with (a) the Promotion or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any prize or component thereof, or (c) participation in any Promotion -related activity or prize-related activity including without limitation in each case any Losses that may be caused or contributed to by (1) any wrongful, negligent or unauthorized act or omission on the part of any of the Released Parties, or any of their independent contractors or any other person or entity not an employee of any of the Released Parties, or (2) any other cause, condition or event whatsoever beyond the control of any of the Released Parties.
In addition, by participating in this Promotion, each entrant agrees to indemnify and hold harmless the Released Parties from and against any and all damages, losses, costs and expenses (including amounts paid in settlement and reasonable attorneys' fees) incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of entrant hereunder, or (ii) entrant’s possession, use or misuse of any prize or component thereof. Each entrant hereby acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize (or any components thereof) and that, except as prohibited by applicable law, prizes are provided "as is" without warranty of any kind, either express or implied. Released Parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement.
FOR RESIDENTS OF THE STATE OF CALIFORNIA: You acknowledge and agree that your release and waiver extend to the following, the protections of which you explicitly waive:
California Civil Code Section 1542: A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.
8. PUBLICITY: Except where prohibited by law, entry into the Promotion and acceptance of a prize constitutes entrants’ permission to print, publish, broadcast, distribute, and use, in any media now known or hereafter devised, worldwide, Winner’s name, city, state, and prize won, as news, publicity or information and for advertising, public relations and promotional purposes, without further payment or consideration, notice, review or approval.
9. GENERAL: Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate the Promotion should a virus, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper play or entry of the Promotion. In such event, Sponsor reserves the right to award the prize by random drawings from among the eligible entries received up to the time of the termination, cancellation, suspension and/or modification.
By participating in the Promotion, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Promotion.
Failure to comply with these Official Rules will result in disqualification from the Promotion. Sponsor reserves the right to permanently disqualify from any Promotion it sponsors any person it believes has intentionally violated these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term or provision of these Official Rules shall not constitute a waiver of that term or provision.
Sponsor is not responsible for late, lost, incomplete, or misdirected entries; computer system, phone line, electronic equipment, computer hardware, software or program malfunctions, or other errors; failures or delays in computer transmissions or network connections; problems downloading entries from the web site; or for any other technical problems related to web site entries. Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of the entries in the Promotion. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
10. LIMITATION OF LIABILITY: Without limiting anything set forth above in these Official Rules, Released Parties shall not have any obligation, responsibility or liability, including any obligation or responsibility to provide a prize to any entrant, with regard to: (a) entries entered through the use of any robotic or automated device/computer program or any other non-human mechanism, entity, or device; (b) entries in excess of the stated entry limit; (c) entries that are illegible, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with or in violation of these Official Rules, whether caused by any equipment or programming associated with or utilized in the Promotion or any other reason beyond Released Parties' control; (d) any technical or human error which may occur in the creation, submission, assignment or processing of entries in the Promotion, including any technical or human error in connection with any social media platforms, Promotion Website and/or the hosting thereof; (e) entries, prize claims or notifications that are not received by the intended recipient due to transmission, technical, computer or human failures or error of any kind, including any entries, prize claims or notifications that are delayed, misdirected, or undelivered as a result of any failure or problem with the availability, functionality, operability or use of any network, server, ISP, website (including the Promotion Website), computer, internet connection, hand-held mobile device, social media platform, or any other equipment or connection used in connection with the Promotion; (f) changes in an entrant’s information which affects the ability to contact such entrant; (g) typographical errors in Promotion promotional material; (h) cancellations and/or delays or any change by any company or any other persons providing any of components of the prizes due to reasons beyond the control of any of the Released Parties; (i) any interruptions/postponement/cancellation of Promotion; (j) human error; incorrect or inaccurate transcription of entry information; (k) any technical malfunctions of the computer on-line system, computer dating mechanism, computer equipment, software, any social media platform, or internet service provider utilized by any of the Released Parties or by an entrant; (l) interruption or inability to access the Promotion, any Promotion -related Web pages (including the Promotion Website), any social media platform, or any on-line service via the Internet due to hardware or software compatibility problems; (m) any damage to an entrant’s (or any third person's) computer and/or its contents related to or resulting from any part of the Promotion; (n) any lost/delayed data transmissions, omissions, interruptions, defects; and/or (o) any other errors or malfunctions, even if caused by the negligence of any one or more of the Released Parties.
11. DISPUTES: Any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved exclusively by the appropriate federal or state court located in Miami-Dade County, Florida, U.S.A., and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Florida, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Florida, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida, U.S.A.
Except where prohibited by law, all entrants agree that (i) any and all such disputes, claims, and causes of action shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; (iii) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental, consequential and/or any other damages, other than actual out-of-pocket expenses; (iv) they waive any and all rights to have damages multiplied or otherwise increased; (v) they irrevocably consent to the personal jurisdiction of the aforesaid courts, as applicable to each such entrant, and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have; and (vi) if any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable, and that in any event, the unenforceability or invalidity of any provision will not affect any other provision of these Official Rules, and these Official Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be.
12. DOCUSIGN REQUIREMENT: Winners will be required to complete the Releases via DocuSign, which will request personally identifiable information.
13. PRIVACY: Information collected through the administration of the Promotion is subject to and may be used and shared by Sponsor in accordance with Sponsor's Privacy Policy at https://www.ncl.com/ca/en/about-us/privacy-policy and applicable law, including in connection with the administration of this Promotion, including, but not limited to, notifying and verifying potential winners, and fulfilling prizes as well as sending marketing correspondence via email.
Personal information collected will be stored on servers located in the United States and may be accessible to U.S. law enforcement, courts and other governmental institutions pursuant to the laws of the United States.

WINNER LIST REQUEST: For a list of the winners, including first name, last initial, and state of residence (available after June 20, 2024), send an email to PartnersFirst@ncl.com with subject line: Norwegian Cruise Line Travel Partner Appreciation Giveaway Winners List Request. Requests must be received no later than June 4, 2024.

The onboard service charges must be pre-paid under this program. Grand Prize is for a double-occupancy stateroom; stateroom upgrades will not be provided by Sponsor. Sponsor is not responsible for any local hotel stays due to airline layovers or missed flights. Grand Prize Winner must be an adult twenty-one (21) years or older. All other expenses not specified herein with respect to prizes are the sole responsibility of the Grand Prize winner. Changes or cancellations made less than one-hundred-twenty (120) days from original sailing date will result in a forfeiture of the cruise.
Sponsor’s determinations regarding the awarding of the Grand Prize is final. No prize substitutions except as provided herein. Ships’ Registry: Bahamas. No individual (including any Guest) under twenty-one (21) years of age will be booked unless accompanied by an adult twenty-one (21) years or older. Prizes are not transferable and may not be given, bartered, sold, or exchanged for cash or another prize, except at Sponsor’s sole discretion due to prize unavailability for any reason and then only for a prize of equal or greater value.
Once a Grand Prize Winner reserves a Grand Prize Cruise from the Applicable Voyages, it is not cancelable, and if the reserved cruise cannot be taken, it will be forfeited.
Taxes on Grand Prizes are the sole responsibility of the Grand Prize Winners. Sponsor, in its sole discretion, reserves the right to substitute prizes of equal or greater value if advertised prizes become unavailable. Sponsor's determinations regarding the awarding of prizes are final. No prize substitutions except as provided. Prizes are non-transferable. No cash alternatives.

6. PRIZE WINNERS: Sponsor will select the potential Grand Prize winners in a random drawing conducted at Sponsor’s offices. Sponsor’s decisions are final.
Ten (10) potential Grand Prize winners will be randomly selected from among all eligible entries received during the Promotion Period on or about May 20, 2024. Sponsor will contact the potential Grand Prize winners by e-mail or phone call submitted by potential winner at the time of entry, and eligibility is subject to verification. Sponsor will make a minimum of two (2) attempts to contact the potential winners within forty-eight (48) hours of the notification date.
If any potential winner cannot be contacted within ninety-six (96) hours of initial notification, after two attempts, including if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit any and all rights to the applicable prize) and the Sponsor reserves the right, in its sole and absolute discretion to randomly select an alternate eligible entrant for the prize in a separate random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.
The potential winner will become a confirmed and verified winner (a “Winner”) after meeting the requirements that follow: 1) Sponsor shall receive verification that Winner qualifies as being twenty-one (21) years of age or older; (2) a verified travel partner of Sponsor; and (3) successful completion of submission form and Norwegian Viva-related post in line with the terms set forth herein. This Promotion is governed by the laws of the United States and Canada, and all federal, state, provincial, and local laws and regulations apply. If potential winner is a Canadian resident, he/she must correctly answer a mathematical skill testing question as a condition of being awarded the Grand Prize.
The potential Grand Prize winners will be required to sign and return, within seven (7) days of notification, an Affidavit of Eligibility, a Liability Waiver, and a Publicity Release (where allowable), and an IRS W-9 form (collectively, "the Releases") as a condition of acceptance of a prize. Please note that the potential Grand Prize winner will be required to furnish his/her social security number on a W-9 form. Sponsor will only use information from the W-9 form to fulfill its tax obligations in connection with these Promotion and for no other purpose. The winner remains solely responsible for paying all federal and other taxes in accordance with the laws that apply in your state of residence. In order to redeem the Grand Prize, the winners must not only complete the Releases via DocuSign, but also a form to select the Applicable Voyage via DocuSign as well. Sponsor shall route the necessary forms and Releases via DocuSign to the winners.
All Releases must be received by Sponsor by the date provided in the respective notifications. If any potential winner cannot: (a) be contacted after two attempts, (b) fails to respond and/or to provide any of the requested Releases within the required time period, (c) is otherwise in non-compliance with these Official Rules, (d) declines to or cannot accept the prize to be awarded, or (e) fails to satisfactorily meet the requirements as determined in Sponsor's sole discretion, he/she will be disqualified and will no longer be eligible for a chance to win a prize.
Acceptance of the Grand Prize constitutes permission to use winner's name and/or likeness by Sponsor for purposes of advertising, editorial and trade purposes without further compensation, unless prohibited by law. By accepting a Grand Prize, each Grand Prize winner represents that he/she have complied with all rules of this Promotion and agree to release Sponsor and its parents, affiliates, subsidiaries, officers, directors and employees, crew members, media partners, printers of promotional material, promotional material suppliers, and advertising, promotion and other coordinating agencies involved in the promotion from any and all liability for injuries, losses, or damages of any kind sustained in connection with the use, acceptance, possession or awarding of prize or participation in any prize or related activities. Each Grand Prize winner further acknowledges that Sponsor has not made, and is not liable or responsible for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including, but not limited to, its quality, mechanical condition, or fitness for a particular purpose. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor which are final and binding in all respects. No more than the advertised number of prizes will be awarded. Entries become the property of Sponsor and will not be acknowledged.
No one is a Winner unless and until the Sponsor officially confirms him/her as a Winner in accordance with these Official Rules.
7. RELEASE; INDEMNIFICATION; DISCLAIMER OF WARRANTY: By participating in the Promotion, each entrant, his/her heirs, executors, administrators and assigns, releases, waives, discharges, and holds harmless the Sponsor, its parent company, and subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Promotion (collectively, the “Released Parties”) from any and all liability for any loss, harm, damage, injury, cost or expense of any nature whatsoever (including attorneys' fees) (collectively, "Losses") which may occur in connection with (a) the Promotion or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any prize or component thereof, or (c) participation in any Promotion -related activity or prize-related activity including without limitation in each case any Losses that may be caused or contributed to by (1) any wrongful, negligent or unauthorized act or omission on the part of any of the Released Parties, or any of their independent contractors or any other person or entity not an employee of any of the Released Parties, or (2) any other cause, condition or event whatsoever beyond the control of any of the Released Parties.
In addition, by participating in this Promotion, each entrant agrees to indemnify and hold harmless the Released Parties from and against any and all damages, losses, costs and expenses (including amounts paid in settlement and reasonable attorneys' fees) incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of entrant hereunder, or (ii) entrant’s possession, use or misuse of any prize or component thereof. Each entrant hereby acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize (or any components thereof) and that, except as prohibited by applicable law, prizes are provided "as is" without warranty of any kind, either express or implied. Released Parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement.
FOR RESIDENTS OF THE STATE OF CALIFORNIA: You acknowledge and agree that your release and waiver extend to the following, the protections of which you explicitly waive:
California Civil Code Section 1542: A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.
8. PUBLICITY: Except where prohibited by law, entry into the Promotion and acceptance of a prize constitutes entrants’ permission to print, publish, broadcast, distribute, and use, in any media now known or hereafter devised, worldwide, Winner’s name, city, state, and prize won, as news, publicity or information and for advertising, public relations and promotional purposes, without further payment or consideration, notice, review or approval.
9. GENERAL: Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate the Promotion should a virus, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper play or entry of the Promotion. In such event, Sponsor reserves the right to award the prize by random drawings from among the eligible entries received up to the time of the termination, cancellation, suspension and/or modification.
By participating in the Promotion, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Promotion.
Failure to comply with these Official Rules will result in disqualification from the Promotion. Sponsor reserves the right to permanently disqualify from any Promotion it sponsors any person it believes has intentionally violated these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term or provision of these Official Rules shall not constitute a waiver of that term or provision.
Sponsor is not responsible for late, lost, incomplete, or misdirected entries; computer system, phone line, electronic equipment, computer hardware, software or program malfunctions, or other errors; failures or delays in computer transmissions or network connections; problems downloading entries from the web site; or for any other technical problems related to web site entries. Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of the entries in the Promotion. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
10. LIMITATION OF LIABILITY: Without limiting anything set forth above in these Official Rules, Released Parties shall not have any obligation, responsibility or liability, including any obligation or responsibility to provide a prize to any entrant, with regard to: (a) entries entered through the use of any robotic or automated device/computer program or any other non-human mechanism, entity, or device; (b) entries in excess of the stated entry limit; (c) entries that are illegible, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with or in violation of these Official Rules, whether caused by any equipment or programming associated with or utilized in the Promotion or any other reason beyond Released Parties' control; (d) any technical or human error which may occur in the creation, submission, assignment or processing of entries in the Promotion, including any technical or human error in connection with any social media platforms, Promotion Website and/or the hosting thereof; (e) entries, prize claims or notifications that are not received by the intended recipient due to transmission, technical, computer or human failures or error of any kind, including any entries, prize claims or notifications that are delayed, misdirected, or undelivered as a result of any failure or problem with the availability, functionality, operability or use of any network, server, ISP, website (including the Promotion Website), computer, internet connection, hand-held mobile device, social media platform, or any other equipment or connection used in connection with the Promotion; (f) changes in an entrant’s information which affects the ability to contact such entrant; (g) typographical errors in Promotion promotional material; (h) cancellations and/or delays or any change by any company or any other persons providing any of components of the prizes due to reasons beyond the control of any of the Released Parties; (i) any interruptions/postponement/cancellation of Promotion; (j) human error; incorrect or inaccurate transcription of entry information; (k) any technical malfunctions of the computer on-line system, computer dating mechanism, computer equipment, software, any social media platform, or internet service provider utilized by any of the Released Parties or by an entrant; (l) interruption or inability to access the Promotion, any Promotion -related Web pages (including the Promotion Website), any social media platform, or any on-line service via the Internet due to hardware or software compatibility problems; (m) any damage to an entrant’s (or any third person's) computer and/or its contents related to or resulting from any part of the Promotion; (n) any lost/delayed data transmissions, omissions, interruptions, defects; and/or (o) any other errors or malfunctions, even if caused by the negligence of any one or more of the Released Parties.
11. DISPUTES: Any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved exclusively by the appropriate federal or state court located in Miami-Dade County, Florida, U.S.A., and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Florida, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Florida, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida, U.S.A.
Except where prohibited by law, all entrants agree that (i) any and all such disputes, claims, and causes of action shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; (iii) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental, consequential and/or any other damages, other than actual out-of-pocket expenses; (iv) they waive any and all rights to have damages multiplied or otherwise increased; (v) they irrevocably consent to the personal jurisdiction of the aforesaid courts, as applicable to each such entrant, and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have; and (vi) if any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable, and that in any event, the unenforceability or invalidity of any provision will not affect any other provision of these Official Rules, and these Official Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be.
12. DOCUSIGN REQUIREMENT: Winners will be required to complete the Releases via DocuSign, which will request personally identifiable information.
13. PRIVACY: Information collected through the administration of the Promotion is subject to and may be used and shared by Sponsor in accordance with Sponsor's Privacy Policy at https://www.ncl.com/ca/en/about-us/privacy-policy and applicable law, including in connection with the administration of this Promotion, including, but not limited to, notifying and verifying potential winners, and fulfilling prizes as well as sending marketing correspondence via email.
Personal information collected will be stored on servers located in the United States and may be accessible to U.S. law enforcement, courts and other governmental institutions pursuant to the laws of the United States.
