This month, enforcement actions in the United States based on the Foreign Corrupt Practices Act (“FCPA”) continued withJohnson Controls, Inc. (“Johnson”) agreeing to pay USD 11,800,000 plus prejudgment interest of USD 1,382,561, and civil penalty of USD 1,180,000 to the U.S. Securities and Exchange Commission (“SEC”) to resolve allegations that its Chinese subsidiary schemed with a third party to bribe Chinese public officials at shipyards to obtain and retain business and gain personal enrichment.  In another settlement, LAN Airlines (now LATAM Airlines Group)agreed to pay a total of USD 9,437,788 to the SEC and entered into a three-year deferred prosecution agreement, including a criminal fine of USD 12.75 million, with the U.S. Department of Justice (“DOJ”) to resolve allegations concerning improper payments to consultant totaling more than USD 1.15 million in connection to a scheme to pay bribes to Argentine union officials through a sham consulting agreement.
In addition, the U.K. Serious Fraud office (“SFO”) announced a number of ongoing enforcement activities. The SFO charged U.K-based logistics and freight operations companyF.H. Bertling Ltd. and seven of its former and current company executives with making corrupt payments to Angolan state oil company to further its business operations in Angola between January 2005 and December 2006. The SFO also confirmed its ongoing criminal investigation, initiated in March 2016, into activities of Monaco-based oil companyUnaoil S.A.M. in connection to alleged bribery, corruption and money laundering.
